Abstract
Jasa layanan konten telah diatur Permen Kominfo No 01 tahun 2009 tentang Penyelenggaraan Jasa Pesan Premium dan Pengiriman Jasa Pesan Singkat (short Messaging service/ SMS). Namun, disebabkan banyak terjadi laporan penipua pulsa SMS premium kepada penegak hukum hingga pada puncaknya adalah tuntutan masyarakat dan parlemen untuk memperbaiki peraturan tersebut, maka disusunlah Permen Kominfo No 21 tahun 2013. Penelitian ini akan menganalisa seberapa efektif perubahan Peraturan Menteri tersebut diatas dengan menggunakan metode Regulatory Impact analysis serta metode kuantitatif melalui wawancara dengan berbagai pihak yaitu regulator, penyelenggara telekomunikasi maupun content provider. Dari hasil penelitian dapat disimpulkan bahwa revisi Peraturan Menteri terkait SMS premium saat ini memiliki kekurangan berupa birokrasi perizinan panjang dan lambat serta pembebanan kontribusi Biaya Hak Penyelenggaraan (BHP) Jasa telekomunikasi dan kontribusi USO pada content provider. Disisi lain Revisi Peraturan Menteri tersebut dapat memberikan lebih banyak jaminan perlindungan pada masyarakat. Kata kunci : SMS konten premium, Regulatory Impact Analysis, Pencurian Pulsa The Content services have been arranged Permen Kominfo No. 01 in 2009 about Implementation Services Premium Messaging Short Message Service (SMS). However, due to a lot going on with premium SMS toll fraud report to law enforcement is up to the peak demand of the people and parliament to improve the regulation, then drafted Permen Kominfo No. 21 in 2013. This paper will analyze how effective the above regulation changes using the Regulatory Impact analysis and quantitative methods through interviews with various parties such as regulators, telecommunication providers and content providers. From the results of this paper concluded that the revised Ministrial Decree regarding premium SMS currently has disadvantage of more bureaucratic procedure of licensing and more burden of License Fees of Telecommunications Services Operator and USO Contribution Fees to content provider. On the other hand the revised regulation can provide more assurances of protection to the consumen. Keywords : SMS premium content, Regulatory Impact Analysis, Billing Fraud
