Abstract

Economic and industrial growth in Indonesia has encouraged the development of port infrastructure, including dredging and reclamation work. Most of this dredging and reclamation work is carried out by specialized Contractor from abroad, leading to the frequent use of FIDIC Form of Contract for Dredging and Reclamation (Blue Book) in Indonesia. Along with the use of FIDIC Blue Book, numerous claims have arisen between Employer and Contractor, some of which escalate in to disputes. Hence, research is essential to analyze the causal factors of these claims leading to disputes in dredging and reclamation projects employing the FIDIC Blue Book Contract in Indonesia. The research utilized a Likert scale questionnaire with 85 respondents. The collected data were processed using SPSS v26.0 and analyzed using the Relative Important Index (RII). The analysis revealed that the primary causative factors for claims leading to disputes in dredging and reclamation projects in Indonesia using the FIDIC Blue Book, as reported by respondents, were delays caused by Employer (A10), differences in the interpretation of contract documents (C5), changes in the scope of work (A6), inadiquate site investigations (A14), and the discovery of obstacles, bombs, and mines left over from World War II (D7). Keywords : Claim, Dredging and Reclamation,Contract Construction, FIDIC Blue Book Pertumbuhan ekonomi dan industri di Indonesia mendorong pembangunan infrastruktur Pelabuhan yang pekerjaannya meliputi pekerjaan pengerukan dan reklamasi. Pekerjaan pengerukan dan reklamasi sebagian besar dilaksanakan oleh penyedia jasa spesialis dari luar negeri mengakibatkan FIDIC Form of Contract for Dredging and Reclamation (Blue Book) edisi tahun 2016 menjadi sering digunakan di Indonesia. Seiring dengan penggunaan FIDIC Blue Book edisi tahun 2016 banyak klaim dan perselisihan antara pengguna jasa dan penyedia jasa yang menyebabkan sengketa. Oleh karena itu diperlukan penelitian tentang analisis faktor-faktor penyebab klaim yang menyebabkan sengketa untuk pekerjaan pengerukan dan reklamasi yang menggunakan kontrak FIDIC Blue Book. Penelitian dilakukan pada proyek pengerukan dan reklamasi di Indonesia yang menggunakan FIDIC Blue Book dengan menggunakan kuesioner skala likert 5 kepada 85 responden. Data diolah dengan menggunakan SPSS v26.0 dan analisis menggunakan Relative Important Index (RII). Dari hasil analisis diperoleh bahwa faktor penyebab utama klaim yang mengakibatkan sengketa pada proyek pengerukan dan reklamasi di Indonesia yang menggunakan FIDIC Form of Contract for Dredging and Reclamation Edition 2016 (Blue Book) menurut gabungan para pihak yang menjadi responden penelitian ini adalah keterlambatan yang diakibatkan oleh pengguna jasa (A10), perbedaan interpretasi dokumen kontrak (C5), perubahan lingkup pekerjaan (A6), penyelidikan lapangan yang kurang lengkap (A14) dan penemuan obstacle, bom dan ranjau sisa perang dunia (D7).
