Abstract

In the national development, construction services have a very strategic role to produce the final product in the form of buildings or other physical forms. In the implementation of the construction project tender process it is common knowledge that the implementation is not in accordance with procedures and there has been a tender conspiracy process, especially for projects funded by the State, whether from the State Budget, Regional Budget or BUMN. Procurement of government goods / services is a part that is indicated by corruption, collusion and npotism. Leak indications can be seen from the large number of government projects that are not biased to follow the presidential regulation RI Number 70 of 2012 (Tibuludji, 2016). As a result, it can be seen that many buildings have collapsed and the short life span of the construction is due to inappropriate or lower quality than the specified technical specifications. In 2018, the KPK recorded 11 cases related to irregularities in the procurement of goods and services with a project value of 9 trillion, with the potential loss of the state of corruption estimated at 9.4 billion involving the Provincial Government, District Government and Also the Working Group (Pokja) Procurement of Goods and Services (KPK),2018). From the results of the analysis found the causes of deviations that occur in the implementation of procurement of goods and services for building construction projects. Dalam pembangunan Nasional jasa konstruksi mempunyai peranan yang sangat strategis untuk menghasilkan produk akhir berupa bangunan atau bentuk fisik lainnya. Pada pelaksanaan proses tender proyek konstruksi sudah menjadi rahasia umum bahwa pelaksanaanya sudah tidak sesuai prosedur dan terjadi proses persekongkolan tender terutama untuk proyek yang didanai oleh Negara baik itu dari APBN, APBD maupun dari BUMN. Pengadaan barang/jasa pemerintah merupakan bagian yang banyak terindikasi terjadi korupsi, kolusi dan npotisme. Indikasi kebocoran yang dapat dilihat dari banyaknya pengadaan proyek pemerintah yang tidak bias mengikuti peraturan presiden RI Nomor 70 Tahun 2012 (Tibuludji, 2016). Akibatnya dapat dilihat banyak bangunan gedung yang yang runtuh dan pendeknya umur konstruksi yang disebabkan tidak sesuainya atau kualitas yang lebih rendah dari spesifikasi teknis yang sudah ditentukan. Dalam kurun waktu tahun 2018 KPK mencatat ada 11 kasus terkait penyimpangan pengadaan barang dan jasa dengan nilai proyek 9 triliun dengan potensi kerugian negara korupsi diperkirakan sebesar 9,4 Miliar yang melibatkan Pemrov, Pemkab dan Juga Kelompok Kerja (Pokja) Pengadaan Barang dan Jasa (KPK, 2018). Dari hasil analisis didapatkan penyebab penyimpangan yang terjaid pada pelaksanaan pengadaan barang dan jasa untuk pekerjaan proyek konstruksi bangunan.
