Abstract

According to the records of Unicef, in the year 2000 there 11.344 child of the suspect as the perpetrator of the criminal act, while in January - May 2002 found the 4,325 child offenders criminal on home detention and correctional institutions throughout Indonesia and even sadder, most (84,2%) of these children are in institutions of detention and imprisonment for adults (Muchtar, 2006: 18). In Law Number 11 Year 2012 on the juvenile Justice System, what is meant by this Law: 1. Criminal Justice system of Children is the whole process of settlement of the child in conflict with the law, starting from the stage of the investigation up to the stage of coaching after undergoing a criminal. 2. Children in conflict with the law is the child in conflict with the law, children who are victims of crime, and the child who became witnesses of a criminal offense. 3. Children in conflict with the law hereinafter referred to as the child is a child who has aged twelve (12) years, but not yet the age of eighteen (18) years of age suspected of committing a crime. The mechanism of handling child in conflict the law in the various provinces, on a variety of government agencies and institutions of society, beginning with the legal process. However, many found the treatment of arbitrary, acts of violence, intimidation, and no relief (assistance) of the law, as the rights of the child in conflict the law in the face of the legal process (Kurniasari, 2006). Menurut catatan Unicef, pada tahun 2000 ada 11.344 anak tersangka sebagai pelaku tindak pidana, sedangkan pada bulan Januari - Mei 2002 ditemukan 4.325 anak pelaku pidana di rumah tahanan dan lembaga pemasyarakatan di seluruh Indonesia dan lebih menyedihkan lagi, sebagian besar (84,2%) anak-anak ini berada di dalam lembaga penahanan dan pemenjaraan untuk orang-orang dewasa (Muchtar, 2006: 18). Dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Anak, yang dimaksud dengan Undang-Undang ini: 1. Sistem Peradilan Pidana Anak adalah keseluruhan proses penyelesaian perkara anak yang berhadapan dengan hukum, mulai tahap penyelidikan sampai dengan tahap pembimbingan setelah menjalani pidana. 2. Anak yang berhadapan dengan hukum adalah anak yang berkonflik dengan hukum, anak yang menjadi korban tindak pidana, dan anak yang menjadi saksi tindak pidana. 3. Anak yang berkonflik dengan hukum yang selanjutnya disebut anak adalah anak yang telah berumur 12 (dua belas) tahun, tetapi belum berumur 18 (delapan belas) tahun yang diduga melakukan tindak pidana. Mekanisme penanganan anak berkonflik hukum di berbagai provinsi, pada berbagai instansi pemerintah maupun lembaga masyarakat, diawali dengan proses hukum. Namun, banyak ditemukan perlakuan sewenang-wenang, tindak kekerasan, intimidasi, dan tidak ada bantuan (pendampingan) hukum, sebagaimana haknya anak berkonflik hukum dalam menghadapi proses hukum (Kurniasari, 2006).
