Abstract

Teknologi dan era globalilsasi telah merubah paradigma manusia untuk selalu mengikuti perkembangannya terutama dalam bidang teknologi komunikasi ICT. Negara Indonesia di bawah pemerintahan Presiden Joko Widodo mempunyai target yaitu negara Indonesia tumbuh menjadi kekuatan ekonomi digital paling besar di level ASEAN di tahun 2020 dengan target transaksi e-commerce mendekati 130 juta dollar. Masalah-masalah yang dihadapi seperti logistik, pendanaan, perlindungan konsumen, infrastruktur telekomunikasi, perpajakan, pendidikan dan sumber daya manusia serta cyber security. Masalah trust-security (kepercayaan dan keamanan data pribadi konsumen) seiring pertumbuhan e- commerce menjadi hal yang harus segera menjadi pokok perhatian oleh pemegang kebijakan. Saat ini data pribadi konsumen di Indonesia belum terlindungi dikarenakan belum adanya regulasi yang mengatur perlindungan data pribadi di Indonesia. Sebagaimana di Uni Eropa telah memberlakukan GDPR (General Data Protect Regulation) yang berlaku untuk 28 negara di Eropa yang mengatur dan melindungi perlindungan data pribadi konsumen. Dengan pendekatan RIA (Regulatory Impact Analysis) menjadikan sebuah masukan atau pertimbangan untuk pemangku kebijakan di Indonesia dalam mengatur dan membuat regulasi tentang perlindungan data pribadi pada khususnya dan e-commerce pada umumnya yang isinya bisa mengadopsi beberapa poin di dalam GDPR. Kata kunci: e-commerce, perlindungan data pribadi, regulasi, GDPR, RIA Technology and globalization have changed the human paradigm to always follow its development, especially in the field of ICT communication technology. The Indonesian state under the administration of President Joko Widodo has the target of Indonesia becoming the biggest digital economic power at the ASEAN level in 2020 with the target of e-commerce transactions reaching 130 million dollars. Problems faced such as logistics, funding, consumer protection, telecommunications infrastructure, taxation, education and human resources and cyber security. The issue of trust-security (trust and security of consumer personal data) as the growth of e-commerce becomes a matter that must immediately become the focus of attention by policy holders. Currently consumer personal data in Indonesia has not been protected due to the absence of regulations that regulate the protection of personal data in Indonesia. As in the European Union, the GDPR (General Data Protection Regulation) applies to 28 countries in Europe that regulate and protect the protection of consumer personal data. With the RIA (Regulatory Impact Analysis) approach, it makes an input or consideration for policy makers in Indonesia in regulating and making regulations regarding the protection of personal data in particular and e- commerce in general, which can adopt a number of points in GDPR.
