Abstract
ABSTRACT Title: Comparative Analysis of Indonesian Government Regulations on Procurement of Construction Services with IDB Procurement Guidelines on Procurement of Contractors by E-Procurement, Name: Sindy Agnesty, Student ID: 41116110008, Supervisor: Ir. Mawardi Amin, M.T. The procurement of contractors on an e-procurement basis with the source of foreign loan funds in its implementation often encounters obstacles that lead to procurement process longer than procurement of e-procurement contractors of pure rupiah funds, which usually caused by the lack of understanding of procurement regulations issued by the lenders. The procurement process also becomes more complex because even the lenders issue their own regulations, the procurement process should still pay attention to the Indonesian Government Regulations as material for the audit process. As consequence, when the procurement process takes longer then there will be extra cost that must be compensated by the State to pay interest on the foreign loan. Therefore, it is necessary to identify the most frequent constraints on procurement stages so harmonization needs to be done at that stage. The formulation of the problem in this research is a comparative analysis of the Indonesian Government Regulations on the procurement of construction services with IDB Procurement Guidelines on e-procurement contractors. Research methodologies that the author used are direct observation (directly involved), field data collection and literature studies. The observation method is undertaken by conducting case studies on the Development Project of Four Higher Education Institutions (4in1 Project) by collecting data such as procurement regulations. The analysis is done by comparative study and Analytical Hierarchy Process toward the stages of procurement implementation. The results of the research indicate the priority sequence of the procurement stages that require harmonization in terms of the criteria of understanding, time and complexity of the selection can be categorized as follows: goods / services provider (34%), preparation of procurement documents (25%), contract implementation (22%), scheduling of goods / service provider selection (10%), and E-tendering (9%). Pengadaan kontraktor secara e-procurement dengan sumber dana pinjaman luar negeri pada pelaksanaannya sering terjadi kendala-kendala yang menyebabkan proses pengadaan lebih lama daripada pengadaan kontraktor e-procurement sumber dana rupiah murni, seperti halnya kurangnya pemahaman terhadap aturan pengadaan yang dikeluarkan pemberi pinjaman. proses pengadaan juga menjadi lebih kompleks dikarenakan meskipun pemberi pinjaman mengeluarkan aturan sendiri tetapi proses pengadaan harus tetap memperhatikan aturan penagdaan yang dikeluarkan oleh Pemerintah Indonesia sebagai bahan untuk proses audit. Ketika proses pengadaan lebih lama maka akan terjadi penambahan beban biaya yang harus dikeluarkan negara untuk membayar bunga dari pinjaman luar negeri tersebut. Oleh karena itu, perlu diidentifikasi tahapan-tahapan pengadan yang paling sering mendapatkan kendala sehingga perlu dilakuakan harmonisasi pada tahapan pengadaan tersebut. Perumusan masalah pada penelitian ini adalah analisi perbandingan aturan Pemerintah Indonesia tentang pengadaan jasa konstruksi dengan IDB Procurement Guidelines pada pengadan kontraktor secara e-procurement. Metodologi penelitian yang penulis gunakan adalah observasi langsung (terlibat langsung), pengumpulan data-data lapangan serta studi litelatur. Metode Obserbasi dilakuakn dengan mengadakan studi kasus pada proyek The Develompent of Four Higher Education Institutions (4in1 Project), dengan mengumpulkan data-data seperti peraturan-peraturan tentang pengadaan. Analisis dilakukan dengan studi komparatif dan Anlytical Hierarchy Process terhadap tahapan pelaksanaan pengadaan. Hasil penilitian menunjukan urutan prioritas tahapan pengadaan yang membutuhakan harmonisasi yang ditinjau dari kriteria pemahaman, waktu dan kompleksitas yaitu Pelaksanaan pemilihan penyedia barang/jasa (34%), Penyusunan dokumen pengadaan barang/jasa (25%), Pelaksanaan kontrak (22%), Penyusunan jadwal pemilihan penyedia barang/jasa (10%), E-tendering (9%).
