Abstract
Design and Build contract schemes are increasingly adopted in Indonesian toll road projects due to their perceived advantages in cost and schedule efficiency. However, integrating design and construction responsibilities into a single contractor escalates technical and contractual uncertainties that may trigger claims and disputes. This study aims to analyze the influence of major risk factors from the contractor’s perspective on claim and dispute potential, and to develop a risk management model aligned with FIDIC 2017 principles. A quantitative approach using Structural Equation Modeling–Partial Least Squares (SEM-PLS) was applied to data gathered from 400 professionals involved in Design and Build toll road projects in Jakarta. The research variables include risks related to owner management, procurement processes, designer capability, contractor capability, and external factors, with risk management effectiveness functioning as a mediating variable. The analysis was further supported by Importance–Performance Map Analysis (IPMA) to identify priority mitigation strategies. The results of the study indicate that the owner management performance, the procurement process, and contractor competence have a significant positive effect on improving risk management effectiveness, which in turn reduces the potential for claims and disputes. The IPMA process shows that the ability of the implementer is the main determining factor, so that improving the competence of the implementing contractor will have the most drastic impact on reducing disputes compared to other factors. The combination of high importance and low performance in Owner Management Capability falls into the “Top Priority” quadrant for improvement. This data implies a strong managerial message that the most urgent root cause of disputes to be resolved does not lie in external factors or the bidding process, but rather within the project owner itself. The novelty of this research is the FIDIC 2017-based predictive causal model of risk–claim–dispute from the perspective of service providers and operational mitigation recommendations for Design and Build toll road projects. Keywords: Design and Build, Construction Risk, Claims and Disputes, Toll Road, SEM-PLS, FIDIC 2017 Kontrak Design and Build banyak digunakan pada proyek jalan tol karena dianggap lebih efisien dalam biaya dan waktu. Namun, penyatuan tanggung jawab desain dan konstruksi dalam satu kontraktor meningkatkan ketidakpastian teknis dan kontraktual yang dapat memicu klaim serta sengketa. Penelitian ini bertujuan untuk menganalisis pengaruh faktor-faktor risiko utama dari perspektif penyedia jasa terhadap potensi klaim dan dispute, serta mengembangkan model manajemen risiko yang sesuai dengan ketentuan FIDIC 2017. Penelitian menggunakan pendekatan kuantitatif dengan metode SEM-PLS terhadap 400 responden profesional pada proyek jalan tol Design and Build di wilayah Jakarta. Variabel penelitian meliputi faktor risiko terkait manajemen owner, proses procurement, kemampuan perencana, kemampuan pelaksana, dan faktor eksternal, dengan efektivitas manajemen risiko sebagai variabel mediasi. Analisis ditunjang oleh IPMA untuk menentukan prioritas mitigasi yang paling berdampak. Hasil penelitian menunjukkan bahwa kualitas manajemen owner, proses procurement, dan kompetensi kontraktor berpengaruh positif signifikan dalam meningkatkan efektivitas manajemen risiko, yang selanjutnya menurunkan potensi klaim dan dispute. Dari proses IPMA menunjukan bahwa Kemampuan Pelaksana menjadi faktor penentu utama sehingga peningkatan kompetensi kontraktor pelaksana akan memberikan dampak penurunan sengketa yang paling drastis dibandingkan faktor lainnya. Temuan kombinasi antara tingkat kepentingan yang tinggi dengan kinerja yang rendah pada Kemampuan Manajemen Owner masuk dalam kuadran "Prioritas Utama" untuk pembenahan. Data ini menyiratkan pesan manajerial yang kuat bahwa akar permasalahan sengketa yang paling mendesak untuk diselesaikan bukan terletak pada faktor eksternal atau proses lelang, melainkan pada internal pemilik proyek itu sendiri. Kebaruan penelitian ini ialah model kausal prediktif risiko– klaim–dispute berbasis FIDIC 2017 dari sudut pandang penyedia jasa serta rekomendasi mitigasi yang operasional pada proyek jalan tol Design and Build.
