Abstract

This thesis will discuss Over The Top (OTT) multimedia Video Streaming services from technical, policy and regulatory aspects. The background of this thesis problem is due to the emergence of several issues in the community, including: a lawsuit from one media group related to the supervision of live streaming broadcasts on social media against the broadcasting law in May 2020, the restriction of access to OTT Video Streaming services on an operator in Indonesia and The emergence of tax issues for OTT video streaming operators from outside Indonesia. From some of the issues that appeared above, the writer formulated several problems including: How should the video streaming regulated? How are the streaming video regulation compared to other countries? What are the options that can be taken to anticipate the development of new technology? This study aims to analyze the improve in regulations that have been carried out, the possibility of regulations that can still be improved by comparing OTT Video Streaming regulations in other countries. Some time ago the government issued a copyright law in order to respond to regulatory needs in several fields including this OTT Video Streaming service, in this thesis the author also compares several rules/regulations that have been implemented in several other countries using benchmarking analysis. Base on the problems above, the writer analyzes the Technical, Policy and Regulatory aspects with the benchmarking method to compare these aspects with the conditions of other countries such as Singapore, Malaysia, Korea, Australia, America, the European Union. The results of the analysis, there are several regulatory improvements that have been made by the government with the issuance of PMK no 35 and PMK no 48 which answer related to taxation so that several OTT Video Streaming (one of which is Netflix) have paid value added tax, in addition to several options that can be applied from the country. others who have previously implemented related regulations in their countries. Keywords: OTT, Video Streaming, Regulasi OTT, Multimedia, Streaming. Thesis ini akan membahas layanan Over The Top (OTT) multimedia Video Streaming dari aspek Teknik, kebijakan dan regulasi. Latar belakang masalah thesis ini karena timbulnya beberapa issue pada masyarakat antara lain: adanya gugatan salah satu group media terkait pengawasan siaran live streaming di medsos terhadap undang-undang penyiaran pada Mei 2020, adanya pembatasan akses layanan OTT Video Streaming pada salah satu operator di Indonesia dan Timbulnya issue perpajakan terhadap operator OTT video streaming yang berasal dari luar Indonesia. Dari beberapa issue yang muncul diatas penulis rumuskan beberapa masalah diantaranya: Bagaimana sebaiknya pengaturan video streaming? Bagaiama pengaturan video streaming dibandingkan dengan negara lainnya? Bagaima opsiopsi yang dapat ditempuh untuk mengantisipasi perkembangan teknologi baru? Penelitian ini bertujuan untuk menganalisa peningkatan regulasi yang sudah dilakukan, kemungkinan regulasi yang masih dapat ditingkatkan dengan membandingan regulasi OTT Video Streaming pada negara lainya. Beberapa waktu lalu pemerintah mengeluarkan undang-undang cipta karya dalam rangka merespon akan kebutuhan regulasi dibeberapa bidang termasuk didalamnya layanan OTT Video Streaming ini, pada Thesis ini penulis juga membandingkan beberapa aturan/regulasi yang telah dijalankan pada beberapa negara lainnya dengan menggunakan analisa benchmarking Berdasarkan permasalahan diatas penulis melakukan analisa terhadap aspek Teknis, Kebijakan dan Regulasi dengan metode benchmarking untuk membandingkan aspek tersebut dengan kondisi negara lainnya seperti Singapura, Malaysia, Korea, Australia, Amerika, Uni Eropa. Dari hasil analisa terdapat beberapa peningkatan regulasi yang sudah dilakukan pemerintah dengan diterbitkannya PMK no 35 dan PMK no 48 yang menjawab terkait perpajakan sehingga beberapa OTT Video Streaming (salah satunya Netflix) sudah melakukan pembayaran pajak pertambahan nilai, disamping itu beberapa opsi yang dapat diterapkan dari negara lainnya yang sudah terlebih dahulu menerapkan regulasi terkait di negara mereka.
