Abstract

In the last few years in the construction industry in Indonesia more and more people are working in EPC / Turnkey, ranging from Engineering Design, Procurement, construction to handover by EPC contractors, but in Indonesia there is currently no standardization of contract (EPC), whereas in the implementation of construction project is very possible for the occurrence of changes that cause the claim among the parties either contractor / service providers and service users, because if the claim can not be settled by contract agreement so that it can lead to a dispute that can even have an impact on the cessation of the project. The purpose of this research is to find the dominant factor causing the claim and minimize it on EPC project. This research was conducted to 42 respondents with qualification in EPC contract field with professional background consisting of 40% of contract field and 60% non contract field. The data obtained based on the results of the samples of the respondents then conducted factor analysis with SPSS software tool. The result of the analysis shows that there are 7 factors formed in which the most dominant factor is "Claims due to either party wanting termination of contract due to prolonged force majure" which explains as much as 78% cause of claim on EPC project, so there is a need to clause in contract to minimize the occurrence of such claims. Based on the FIDIC EPC / Turnkey contractuality clauses related to the termination of contract due to force majure is Clause 19 on "force majure", Subclause 19.1, 19.2, 19.3, 19.4, 19.5, 19.6, 19.7., Clause 17 on " User Service Risk ", Subclause 17.3, 17.4., Clause 20 on" Claims ", Sub Clause 20.1 on" Contractor Claims ", Sub Clause 3.5 on" Provision ". Keyword: Claim, EPC,FIDIC, conditions of contracts i Dalam beberapa tahun terakhir industri konstruksi di Indonesia semakin menigngkat dimana kontrak yang banyak digunakan pada jenis proyek tersebut adalah kontrak EPC/Turnkey, mulai dari pekerjaan Desain Engineering, Procurement, konstruksi sampai dengan serah terima dilakukan oleh pihak kontraktor EPC, namun di Indonesia saat ini belum ada standarisasi kontrak (khususnya EPC), padahal pada pelaksanaan proyek konstruksi sangat memungkinkan untuk terjadinya perubahan yang menimbulkan adanya klaim diantara para pihak baik penyedia jasa maupun pengguna jasa, sebab apabila klaim tersebut tidak bisa dituntaskan secara kesepakatan kontrak maka dapat menimbulkan terjadinya sengketa yang bahkan dapat berdampak pada terhentinya proyek. Tujuan dari penelitian ini adalah untuk mencari faktor dominan penyebab klaim dan meminimalkannya pada proyek EPC. Penelitian ini dilakukan kepada 42 responden dengan kualifikasi di bidang kontrak EPC dengan latar belakang jabatan yang terdiri atas 40% dibidang kontrak dan 60% di bidang non kontrak. Data yang diperoleh berdasarkan hasil kesioner dari para responden kemudian dilakukan analisis faktor dengan alat bantu software SPSS. Hasil dari analisis tersebut diperoleh bahwa ada 7 faktor yang terbentuk dimana faktor paling dominan adalah “Klaim akibat salah satu pihak menginginkan pemutusan kontrak akibat adanya force majure yang berkepanjangan” yang menjelaskan sebanyak 78% penyebab terjadinya klaim pada proyek EPC, sehingga perlu adanya klausula di dalam kontrak untuk meminimalkan terjadinya klaim tersebut. Berdasarkan Persayartan kontrak FIDIC EPC /Turnkey klausula-klausula yang terkait dengan dengan pemutusan kontrak akibat adanya force majure adalah Klausula 19 tentang “force majure”, Sub Klausula 19.1, 19.2, 19.3, 19.4, 19.5, 19.6, 19.7., Klausula 17 tentang “Resiko Pengguna Jasa”, Sub Klausula 17.3, 17.4., Klausula 20 tentang “Klaim”, Sub Klausula 20.1 tentang “Klaim Kontraktor”, Sub Klausula 3.5 tentang “Penetapan”.
